Privacy Policy of Klein Rechtsanwälte Ltd. (“Klein Attorneys”)

Klein Attorneys is highly concerned about protecting and ensuring the security and confidentiality of the data, including personal data, Klein Attorneys receive in the course of their business activities or which they obtain and/or process from publicly available sources (“Klein-Data”). Klein-Data will be processed in accordance with the provisions of the applicable Swiss data privacy laws and, if applicable, the European General Data Protection Regulation (“GDPR”). In case Klein-Data were received from clients, they are subject to the attorney-client privilege.

Klein-Data consist of information which Klein Attorneys receive and/or collect in connection with their existing, former or potential client relationships and other existing, former or potential contractual relationships, from business partners, family members, consultants, legal representatives, etc. of Klein Attorneys’ clients, in connection with employment interviews, as well as in connection with the operation of websites operated by Klein Attorneys (www.kleinlaw.ch, www.klein-law.ch, www.kleinlegal.ch, www.klein-legal.ch, www.kleinlegal.com, www.klein-legal.com, www.kleinlawyers.ch, www.klein-lawyers.ch, www.klein-lawyers.com, www.kleinlaw.swiss, www.klein-law.swiss, www.kleinlawyers.swiss, www.klein-lawyers.swiss; hereinafter all together “Klein-Websites”) and the related applications in which Klein Attorney have a legitimate interest according to  their corporate purpose and/or which at the discretion of Klein Attorneys are necessary for the conduct of their business.

To the extent permitted by law, Klein Attorneys gather Klein-Data also from publicly accessible sources (e.g. debt registers, land registers, commercial registers, attorneys’ registers, media, internet) or obtain these from clients, contractual partners, courts, arbitral tribunals, public authorities, correspondence lawyers, business information systems and/or other third parties.

In particular, Klein-Data include information and details relating to regulatory and judicial procedures, professional functions and activities of clients and third parties, information on financial status and credit reports compliance with legal and regulatory obligations, bank and insurance disclosures, as well as all other further data which are relevant for the course of business of Klein Attorneys. Furthermore, Klein-Data contain addresses and information related to the use of Klein-Websites.

Klein-Data serve the purpose of providing legal services, protecting clients of Klein Attorneys, the purchase and sale of products and services from and to third parties, other acts related to the corporate purpose which are  necessary in the course of business, the safeguarding of the interests of Klein Attorneys as well as the compliance with legal and regulatory obligations in Switzerland and abroad and detections of   infringements in this regard, the development of offers, services and websites and other platforms on which Klein Attorneys is present, advertisement and marketing, the organization of events, the protection of domiciliary rights and other measures to ensure the safety of IT, premises and facilities and the protection of the organs and the employees of Klein Attorneys and other individuals and assets entrusted to Klein Attorneys.

Klein-Websites use “cookies”, Google Analytics and similar technologies for marketing purposes. Providers of these services do not receive any data about clients, business partners or other third parties from Klein Attorneys.

Additional data is automatically collected by certain IT systems when visiting Klein-Websites. These are mainly technical data (e.g. internet browser, operating system or time of the page access). The collection of these data takes place automatically as soon as Klein-Websites is accessed.

For security reasons and to protect the transmission of confidential information, Klein-Websites use an SSL or TLS encryption. With an encrypted connection, the address line of the browser changes from “http: //” to “https: //” and a padlock icon appears in the browser line. If SSL or TLS Encryption is activated, the transmitted data cannot be read by third parties.

On Klein-Websites, the IP anonymization feature is activated. Thus, prior to transmission to the United States, the IP address will be shortened by Google within member states of the European Union or other parties to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be sent to a Google server in the US and shortened there. On behalf of the operator of Klein-Websites, Google will use such information to evaluate the use of Klein-Websites, to compile reports on website activity and to provide other services related to website activity and internet usage to the website operator. The IP address transmitted as part of Google Analytics and the user’s browser will not be merged with any other data provided by Google.

Klein-Websites use so-called web fonts, provided by “fonts.com”, a typeface service of Monotype LLC., Horexstrasse 30, 61352 Bad Homburg, Germany, for the uniform presentation of fonts. When accessing Klein-Websites, the user’s browser downloads the required web fonts into the browser cache to display texts and fonts correctly.

For this purpose, the browser used by the user, needs to connect to the servers of fonts.com. As a result, fonts.com acquires knowledge that the IP address of Klein-Websites has been accessed. The utilization of fonts.com is in the interest of a consistent and appealing presentation of Klein-Websites. In order to allow counting and to prevent misuse of the counter, fonts.com will store IP addresses in an encrypted format and delete them after 30 days.

If the browser used does not support web fonts, a default font will be used for the illustration.[DK1] 

In the context of the corporate purpose of Klein Attorneys and in particular for the performance of legal services as well as for the business practice in general, Klein-Data can be disclosed to third parties in Switzerland and abroad. In doing so, all legal requirements will be abided by, in particular the attorney-client privilege.

Klein-Data are processed and stored in accordance with legal retention and documentation obligations and/or the legal prescription periods as well as long as required for legitimate business interests.

Klein Attorneys take all legally designated and appropriate technical and organizational security measures to protect Klein-Data.

Starting a business relationship with Klein Attorneys obliges the person concerned to provide data to Klein Attorney, so that they can fulfil their contractual obligations. A refusal to provide required data authorizes Klein Attorneys to immediately terminate the business relationship.

In accordance with applicable data privacy laws and, if applicable, the GDPR, one has the right to access, rectify and erase its personal data, the right to restrict the processing or to object to data processing or to recall the consent to data processing in addition to the right to receive certain personal data for the purpose of transferring such data to another controller. Exercising these rights requires that the identity of the person concerned is clearly established. Klein Attorneys reserve the right to assert those designated restrictions in connection with the rights listed herein.

Klein-Data is processed and retained as long as required for the performance of Klein Attorneys’ contractual obligations and compliance with legal obligations or other purposes pursued with the processing. Further, Klein-Data may be retained for the period during which claims can be asserted against Klein Attorneys.

Klein Attorneys reserve the right to amend this privacy policy in individual cases with additional privacy statements.
